If Flynn Is Small Fry, Who’s the Bigger Fish in Mueller’s Net?

The former national-security adviser pleads guilty to making false statements, and is now cooperating with the special counsel’s investigation.

Whatever is on President Trump’s Christmas list, it didn’t include Friday’s news: Special Counsel Robert Mueller has charged former National-Security Adviser Michael Flynn with making false statements to the FBI about his conversations with then-Russian Ambassador Sergey Kislyak. Worse, Flynn pleaded guilty Friday morning at federal court in Washington.

It’s an ironic turn for a man who first reached widespread national attention leading chants of “Lock her up!” about Hillary Clinton at the 2016 Republican National Convention.

And it is monumental news in the special counsel’s investigation, dwarfing even the indictment of former Trump campaign chairman Paul Manafort. First, and most bluntly, it’s notable because the former national-security adviser, the closest adviser to the president on the most sensitive issues of defense and national safety, is pleading guilty to a felony committed while he served as national-security adviser.

Second, the move puts Mueller’s investigation inside the White House. As I wrote last month, a Flynn indictment filled the Trump team with particular dread, and for good reason. Before the Flynn charge, Mueller had charged two former campaign staffers with crimes committed outside of the campaign, and a low-level campaign staffer had pleaded guilty to lying to federal agents about his contacts with Russians during the campaign.Flynn, in contrast, was a top adviser to the president in the White House before he was fired in mid-February, for lying to Vice President Mike Pence about his conversations with Kislyak. That made his tenure as national-security adviser historically brief. So far, the special counsel has released little information about the charges, but the two-page document indicates that Flynn’s conversations with Kislyak concerned presidential policy. According to the special counsel, Flynn spoke to Kislyak asking him to refrain from responding to new sanctions imposed in the waning days of the Obama administration, and that Flynn asked Kislyak to delay or defeat a UN Security Council vote; he then lied about those conversations with the FBI.The fact that Flynn was operating on behalf of the incoming government represents the first concrete case of Trump’s presidential staff, rather than his campaign team, covering up contacts with Russia. Prosecutors said in court filings on Friday that Flynn called a “senior official of the Presidential Transition Team” on December 29, after being contacted by Kislyak, and was told that the transition did not want Russia to escalate the situation. Flynn then called Kislyak to request that Russia respond only in a reciprocal manner, which it subsequently did.The filings also said that, on December 22, “a very senior member of the Presidential Transition Team” directed Flynn to contact officials from foreign governments about a pending UN Security Council resolution on the issue of Israel settlements, to find out where they stood and to persuade them to delay or defeat the resolution. Flynn made that request of Kislyak that same day, but Kislyak told him the following day that Russia would not oppose the resolution if it came to a vote. (It passed with 14 votes in favors, and only the U.S. abstaining.)

Third, the plea appears to corroborate reports that Flynn was working toward a deal in which he would plead guilty in exchange for cooperating with the government. That’s also bad news for the Trump administration, because it indicates that Flynn knows something of value to the special counsel’s investigation. Mueller’s choice of lieutenants has suggested he is seeking to flip key witnesses in order to learn essential information, but so far that had only yielded George Papadopoulos, a previously little-known campaign aide. Flynn is a far larger catch. In fact, one might expect the national-security adviser to be near the top of the food chain, since he reports directly to the president. If Flynn is small fry, how many bigger fish are there, and who?

Fourth, it’s notable that the charge against Flynn is lying to the FBI. That’s because it has been more or less known since February that he did so. On February 16, three days after Flynn’s forced resignation, The Washington Post reported both that Flynn had denied speaking with Kislyak about the sanctions in a conversation with FBI agents, and that intelligence intercepts indicated he was lying. The FBI interview took place on January 24; on January 26, then-Acting Attorney General Sally Yates spoke to White House Counsel Don McGahn, and in testimony in May she implied that she had informed McGahn that Flynn lied to FBI agents. The investigation into Flynn’s alleged lying to FBI agents long-predates Mueller’s appointment as special counsel in May.


Flynn could also be in trouble for things he did before he was appointed national-security adviser. After leaving the military, Flynn was paid for trips overseas, including one to Russia for a fete celebrating RT, the Kremlin-backed news and propaganda outlet; at dinner, Flynn was seated with President Vladimir Putin. As former top brass, Flynn should have sought Pentagon permission before taking those trips; he also should have disclosed them when applying to renew his security clearance in 2016. Members of Congress allege that Flynn did neither.

These are only the incidents which have been publicly reported. Mueller may or may not know of other possible misdeeds.

The obvious question any time someone is caught lying to the FBI is, How could they have been so stupid? This is especially true in the case of Flynn, the former head of the Defense Intelligence Agency. As a decorated and accomplished intelligence officer, he should have known that conversations with the Russian ambassador might be surveilled, producing irrefutable evidence that he was lying. His decision to lie about such a black-and-white matter raises questions about whether he might have hoped to cover something up.

The plea once again raises questions about the president’s judgment, both in hiring Flynn and afterwards. Flynn’s firing from the DIA by President Obama for mismanagement ought to have been a red flag. The campaign did not effectively vet Flynn, failing to turn up the missing security-clearance disclosures. The New York Times reports that Flynn told the Trump transition team in January that he was under investigation for undisclosed lobbying on behalf of Turkey. Top White House officials deny they were informed.

Nor did Trump act swiftly to deal with Flynn’s duplicity. Even after McGahn was apparently informed that Flynn had lied to the FBI, Trump did not force Flynn out until February 13—and then only after The Washington Post reported that Flynn had lied about his conversations with Kislyak. At the time, the White House said Flynn was forced out for lying to Mike Pence, and it also defended his character, even as it knew he’d lied to the FBI.

Once Flynn had been fired, the president pressured then-FBI Director James Comey to drop the investigation into Flynn, one of several incidents in which the president attempted to interfere in FBI probes. On May 9, Trump fired Comey, a decision he attributed to the Russia probe. Here, too, Trump’s aggressive steps to defend Flynn seem to defy simple explanation. Flynn’s plea could tie into a reported investigation into whether Trump obstructed justice by firing Comey.

Given the brevity of the public documents, there’s little else to be gleaned at this point. Mueller’s investigation has been highly disciplined about leaks, with little information reaching the public. There’s no way to predict how soon information obtained from Flynn might reach the public or help to produce fresh charges. But the simple fact of Mueller nabbing Flynn now is enough to take a little merrimentout of the president’s Christmas.

First, he tried to shut down the investigation of Mike Flynn. Then it turned out that Mike Flynn is probably just a piece of a much larger problem, which is Russia. Trump admitted to the Russian ambassador and to the Russian foreign minister shortly after he fired Comey that now he’s got some relief from the Russia problem — in other words, Comey’s gone! But what’s happened since then is the continuing effort to interfere with the investigation, even in the form of tweets — all of which sure look a lot to me like witness intimidation for some of the key players in the saga.

And then there’s a third component, which is in a way the most insidious — the willingness of the congressional GOP to be complicit in all of this. We’re talking now about a prescription for disaster for democracy. It’s all part of the same story. If you think about it, every single person who has said something about there being no connection between Trump and Russia during the campaign has been caught in a lie about it. Even with this fellow George Papadopoulos, the talking point immediately became, “Well, he didn’t get in trouble for anything that he did, he got in trouble for lying to federal investigators.” Sure, and what was he lying to federal investigators about? About whether or not there were any contacts between the Trump campaign and Russia. And that’s the part that everybody glosses over in terms of the talking points on the Republican side.

He quotes Steele saying that “Russian intelligence has been secretly cultivating Trump for years.” As you and I discussed in August, Trump appears to have attracted the attention of Soviet intelligence as far back as 1987, on his first visit to Moscow — a visit arranged by the top level of the Soviet diplomatic service, with the assistance of the KGB.

Former Trump campaign manager Paul Manfort allegedly violated orders from the judge who is presiding over his case by attempting to sneak a ghostwritten op-ed in praise of Paul Manafort into the press, according to court filings that special counsel Robert Mueller’s team issued on Monday. Mueller’s office changed its position on the loosening of bail terms for Manafort based on the alleged attempted shenanigans.

On Wednesday, Talking Points Memo published the op-ed in question, which it received from professed author Oleg Voloshyn. It is a hoot!

TPM reported that the op-ed could be described as a “love letter to Manafort.” That description, however, does a disservice to love letters, which generally are a little more subtle.

The underlying reason for executive privilege -- that a chief executive is entitled to candid advice from close aides without fear that such discussions would be revealed in a courtroom -- has been upheld in the courts.

But while validating the theory of executive privilege, those courts have sometimes refused to let a president exercise it. The most important test of the doctrine was the Supreme Court's decision in 1974 that both formally established executive privilege and ruled that Nixon could not hide criminal behavior behind it. The contents of Nixon's White House tapes ultimately ended his presidency.

Won't work...Mueller operates under the same branch of government as Trump (executive).  I expect Bannon to really go after Kushner (Javanka)!  

Axios said executive privilege probably wouldn’t apply to the Mueller interview, because Mueller himself is working for the executive branch. 

Bannon “can say whatever the hell he wants to say to [Mueller] about whatever topic that he wants,” a source familiar with Bannon’s thinking told Axios.

Thirteen Russians have been criminally charged for interfering in the 2016 US election to help Donald Trump, the office of Robert Mueller, the special counsel, announced on Friday.

Mueller’s office said 13 Russians and three Russian entities, including the notorious state-backed “troll farm” the Internet Research Agency, had been indicted by a federal grand jury in Washington DC.

A 37-page indictment alleged that the Russians’ operations “included supporting the presidential campaign of then-candidate Donald J Trump ... and disparaging Hillary Clinton,” his Democratic opponent.

Mueller alleged that Russian operatives “communicated with unwitting individuals associated with the Trump campaign”, but the indictment did not address the question of whether anyone else in Trump’s team had knowingly colluded.

Rod Rosenstein, the deputy attorney general, said at a press conference in Washington: “There is no allegation in this indictment that any American had any knowledge.” Rosenstein added that the charges did not mean the Russian activity had an effect on the outcome of the election.

The Russians allegedly posed as Americans to operate bogus social media accounts, buy advertisements and stage political rallies. They stole the identities of real people in the US to post online and built computer systems in the US to hide the Russian origin of their activity, according prosecutors.

“This indictment serves as a reminder that people are not always who they appear to be on the internet,” said Rosenstein. He alleged that the Russians had “worked to promote discord in the United States and undermine public confidence in democracy,” adding: “We must not allow them to succeed.”

The charges state that from as far back as 2014, the defendants conspired together to defraud the US by “impairing, obstructing, and defeating the lawful functions of government” through interference with the American political and electoral processes.

One defendant, Yevgeniy Prigozhin, is accused of using companies he controlled – including Concord Management and Consulting, and Concord Catering – to finance the operations against the US. The operation at one stage had a monthly budget of $1.25m, according to Mueller, which paid for operatives’ salaries and bonuses.

Events were organised by Russians posing as Trump supporters and as groups opposed to Trump such as Black Lives Matter, according to prosecutors. One advertisement shortly before the election promoted the Green party candidate Jill Stein, who is blamed by some Clinton backers for splitting the anti-Trump vote.

In August 2016, Russian operatives communicated with Trump campaign staff in Florida through their “@donaldtrump.com” email addresses to coordinate a series of pro-Trump rallies in the state, according to Mueller, and then bought advertisements on social media to promote the events.

At one rally in West Palm Beach, a Russian operative is even alleged to have paid Americans to build a cage on a flatbed truck and to have an actor posing as Clinton in a prison uniform stand inside.

One defendant, Irina Kaverzina, is accused of admitting her involvement in the operation and a subsequent coverup in an email to a relative in September last year, after Mueller’s inquiry had begun. “We had a slight crisis here at work: the FBI busted our activity,” Kaverzina allegedly wrote, “so I got preoccupied with covering tracks together with the colleagues.”

The Russians are also accused of working to suppress turnout among ethnic minority voters. They allegedly created an Instagram account posing as “Woke Blacks” and railed against the notion that African Americans should choose Clinton as “the lesser of two devils” against Trump.

In early November 2016, according to the indictment, the Russian operatives used bogus “United Muslims of America” social media accounts to claim that “American Muslims [are] boycotting elections today.”

Following Trump’s victory, the Russian operation promoted allegations of voter fraud by the Democratic party, according to Mueller’s team. Around that time, Trump repeatedly claimed without evidence that he would have won the popular vote if not for large-scale voter fraud.

The individuals charged are Mikhail Ivanovich Bystrov, Mikhail Leonidovich Burchik, Aleksandra Yuryevna Krylova, Anna Vladislavovna Bogacheva, Sergey Pavlovich Polozov, Maria Anatolyevna Bovda, Robert Sergeyevich Bovda, Dzheykhun Nasimi Ogly, Vadim Vladimirovich Podkopaev, Gleb Igorevitch Vasilchenko, Irina Viktorovna Kaverzina, Yevgeny Viktorovich Prigozhin and Vladimir Venkov.

All were charged with conspiracy to defraud the United States. Three defendants were charged with conspiracy to commit wire fraud and bank fraud, and five defendants were charged with aggravated identity theft.

Separately, Mueller’s office announced that Richard Pinedo, of Santa Paula, California, had pleaded guilty to identity fraud. Pinedo, 28, admitted to running a website that offered stolen identities to help customers get around the security measures of major online payment sites. It was not made clear whether his service had been used by the Russian operatives.

Rosenstein said no contact had been made with Russian authorities regarding the charges so far, but that US officials intended to seek extradition of the defendants.

US intelligence agencies previously concluded that Russians mounted an attack on the US election system aimed at electing Donald Trump to the presidency.

Mueller is conducting a criminal inquiry into interference by Russians and possible collusion by Trump’s campaign. Two Trump campaign advisers have pleaded guilty to lying to the FBI. Two others have been charged with federal crimes.

US investigators have long signalled their belief that Prigozhin, a 56-year-old billionaire businessman, is behind Russia’s internet troll factories.

Nicknamed the “Kremlin’s chef”, Prigozhin once ran Putin’s favourite restaurant in St Petersburg, after which he was awarded multi-billion pound state catering contracts.

He provided catering for Dmitry Medvedev’s presidential inauguration in 2008, and also has lucrative contracts to feed Russia’s army and Moscow’s schoolchildren.

Prigozhin, who has also been linked to the Wagner Group, a shadowy Kremlin-linked private military contractor believed to be operating in Syria, was included on a US sanctions list in July.

Speaking to the RIA Novosti state news agency on Friday, Prigozhin said: “The Americans are really impressionable people, they see what they want to see. I have great respect for them. If they want to see the devil – let them see him.”

Russian foreign ministry spokeswoman Maria Zakharova called the allegations “absurd”.

“13 people carried out interference in the US elections? 13 people against special services with a budgets of billions?” she wrote in a Facebook post.

Vladimir Putin’s spokesman Dmitry Peskov told Russian media he had not yet had a chance to study the indictments.

Honestly, I think this is designed to buy time and silence the calls to fire Mueller. His team is top heavy with people who's field of expertise is in money laundering. This is not what they're concentrating on, but it is significant in it's implications concerning the election.

It looks to me as if the question of Russian electoral influence is clearly answered. - YES!  There sure was!

However, much as I dislike and mistrust Trump, there is no proof (yet) of his collusion,- at least no definitive proof.  Although I personally doubt his innocence, it is only fair to give him the benefit of said doubt; at least unless/until real concrete proof emerges.  I know he looks as dirty as sin, but that is appearance - not proof.
How do you tell if a politician is lying?

So this is what we know...  Russian companies spent around a million dollars a month to buy political influence.   Even so there is no distinct pro trump quality to it.... they just wanted to create chaos.  Hillary spent a billion dollars so this Russian program was  just chump change.    The DNC leaks where probably an inside job.   There was no collusion according to Muller his report states that no Americans knowingly helped the Russians.   Nobody alleges that the vote count was altered or manipulated in any way. 

The whole purpose of this conspiracy was not to get Trump elected, it is a simple continuation of a long term soviet goal of getting Americans not to trust their political system.   With all the hysteria from the media and dems I think this plan  has been far more successful than they could have hoped for.

As a matter of fact I expect this whole thing to go away soon... way to many democrats have dirty hands in this...    nobody wants a full investigation.

I honestly want to know, for those saying that Trump colluded what did trump get from it?    Like I said that million dollars a month they spent was like pissing in the ocean, the DNC leaks by all accounts really does seem be an inside job, maybe the Russians were responsible for the Podesta emails I don't know.  Even so the emails didn't tell us anything we didn't already know.... I don't think they swayed many people.

How did Trump benefit from any of this?

Edit: I will concede that perhaps Trump could have been duped but I don't see any motivation for him to be willingly involved.

That does not mean he colluded, but it does give him motive.
