Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail.
The JCT letter makes clear that Americans who do not maintain "acceptable health insurance coverage" and who choose not to pay the bill's new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.
In response to the JCT letter, Camp said: "This is the ultimate example of the Democrats’ command-and-control style of governing - buy what we tell you or go to jail. It is outrageous and it should be stopped immediately."
Key excerpts from the JCT letter appear below:
"H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax." [page 1]

"If the government determines that the taxpayer's unpaid tax liability results from willful behavior, the following penalties could apply..." [page 2]

"Criminal penalties
Prosecution is authorized under the Code for a variety of offenses. Depending on the level of the noncompliance, the following penalties could apply to an individual:
Section 7203 - misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.
Section 7201 - felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years." [page 3]
When confronted with this same issue during its consideration of a similar individual mandate tax, the Senate Finance Committee worked on a bipartisan basis to include language in its bill that shielded Americans from civil and criminal penalties.
The Pelosi bill, however, contains no similar language protecting American citizens from civil and criminal tax penalties that could include a $250,000 fine and five years in jail.
"The Senate Finance Committee had the good sense to eliminate the extreme penalty of incarceration. Speaker Pelosi's decision to leave in the jail time provision is a threat to every family who cannot afford the $15,000 premium her plan creates. Fortunately, Republicans have an alternative that will lower health insurance costs without raising taxes or cutting Medicare," said Camp.
According to the Congressional Budget Office the lowest cost family non-group plan under the Speaker's bill would cost $15,000 in 2016.

Well if this can be shelved for a year, maybe by then some people will realize it is time to dump the representatives who dont listen to the people.
The people were not in favor of the bail out of the banks and still our representatives both rep and demo voted for it, so the best thing to do is vote against anyone who is holding a political position. It is time to dump the dead wood. |

Whoosh Mary- and I thought I could type fast. I think I posted to you on discussion. What does this mean to my grandmother in law and mother in law with disability at about $11,000 a year a apiece. They are living hand to mouth, on food stamps, and you can't be serious. They can't possibly take granny and momilaw and put them into lockup. And fines- sheesh - they are lucky to save up $10 for an Arbies- this is not exactly big economy central.
I understand the idea of a gray panther uprising is not likely. It might be as effective as a revolt over the tomato on a piece of bread that was offered in convalescent home I worked. Do you want a dinner tray? they said. I was excited- visions of veal parmigiana - but well- In Vegas we have another breed of oldster with racing striped jumpsuits- huge dollar filled buckets and glued to a slot machine- or ever been on the Love Boat and seen who can afford it? There are definitely older rich - and they are not really that hot on supporting the massive tide of illegal immigrants that are thrashing our economy. Lets take a poll here... how many illegal immigrants will be deported for not paying for their health care? And what about the munchkins- mini legals born inside the U.S.- are they going to pay $10,000 a head for little Jimmy and Suzie? I mean do they pay that now for them to go to school and be educated? Has the term voice of the American people been considered in all of this frantic hustle? You realize the let them eat cake thing was not a crowd pleaser- and even if marie was whatever race and had the charisma of Ronald MacDonald (to kids) 10.8 unemployment- what could be a real fun Christmas in bed with the flu and not a lot of K-mart shoppers... mass of data here Mary. I expect we will see the Senate bill strewn about on some post here- or some key parts - I think I saw a Pelosi special http://en.wikipedia.org/wiki/Nancy_Pelosi on the wonders of what was passed by 2 votes? there's a screaming landslide voter voice- You take a person on welfare (when there was welfare) and send them to a counselor and they say- now you must learn to budget your money and stop being frivolous. Person says-I have two dollars. So we must budget the unseen from the group we swore not to tax, and gotta love the budget cuts. How are you going to give better care to more people and spend less than what we are now? You aren't. The real pickle. It is on the first of Janurary I think- the hammer comes down. Out of money. Family here- can't mortgage the house- owe more than it is worth. Anybody looked in the fine print on extended care. You know we had this guy in Oregon who they passed this no more medicine law- and he had to have his medicine and was told. Health care is a privelidge not a right. He died. When people start dying - well still can't imagine two elderly ladies in day glow orange at 64 and 83. What is wrong with this picture? Why do I feel there is rampant flu and it is effecting people's thinking? It like a bunch of drunk people or otherwise chemically enhanced in a bar saying- hey- I have a great idea -lets open a carwash and we will get rich. Everyone gets really into it. Carwash pictures on napkins- carwash figures for 10,000 cars in a small almost ghost town- and what kind of skates will the girls wear- yep this carwash needs skates. Med, if they are 64 and 83 wouldn't they already have healthcare through Medicare? If so then they would already have health insurance. I think this is aimed at people who choose not to get health insurance even though it is offered to them. Example: we have a friend who works for the state, while he has to have insurance on himself (it is a state requirement) he does not have to choose it for his family. he instead chooses to have his children be on the state Soonercare (medicaid program) and his wife who is diabetic, uses the free/indigent clinic. The wife doesn't work by choice, not because she can't. So his family could have excellent healthcare for under $150 a month paid for out of his pocket, the job picks up the rest. He does not want to pay out of his pocket for it, so therefore, we the tax payers get to pay for his family to be treated with medical care. I personally would not be opposed to someone having to pay in a case like this. Now if they truely can't pay, then that is different. The elderly have Medicare, so they have insurance already, I can't imagine they would have to purchase more insurance. |

I know... it seems odd...that a person on Medicare ..in their 70's and 80's would have to
pay more... but they do.
My parents had to buy Medi-Gap insurance through AARP. It pays for what medicare does
not...at the hosp. etc.

How much will health bill cost? Depends on what language it's in

and squeeze hundreds of billions of dollars in savings from Medicare over 10 years.
The cost estimates do have some value, said Joshua Gordon, policy director at the Concord Coalition, a budget watchdog group, because they help explain fiscal trends that are likely under the legislation. However, he added, such analyses "are a very imprecise thing, and even more so because we're dealing with long term health care costs."
CBO and independent budget experts warn that any long-term cost projections for this legislation are subject to a wide range of variables.
Among them:
Participation. While the CBO estimated that the number of uninsured Americans would be reduced by 29 million people, leaving 25 million without coverage, there's no way to know what people would do. Elmendorf warned that "a wide range of changes could occur, in people's health, in the sources and the extent of their insurance coverage and in the delivery of medical care."
Political memories. Lawmakers remember the controversy over the price of the new Medicare prescription drug program six years ago. The Bush administration was skewered after it was revealed that it deliberately underestimated the program's cost as Congress considered the legislation. Some Republicans at the time had insisted that they wouldn't support any measure costing more than $400 billion over 10 years, so the administration said it wouldn't cost that much.
Later, Medicare officials admitted that they'd hidden their initial 10-year estimate of $551 billion.
Overhead. "We have not taken into account all the proposal's effects on spending for other federal programs," Elmendorf said, "or estimated the federal government's administrative costs for oversight and implementation . . ."
Economics. Will inflation remain stable? Will another recession send more people into Medicaid, the government's health program for the poor? Will rising unemployment push more people under the poverty level, so they wouldn't have to buy coverage or pay a penalty?
Then there's the biggest variable of all:
What will the final legislation say when it's put into legal language?
Democrats insist that any changes won't be so radical that the CBO's preliminary analyses
will be upended.
Others aren't so confident.

Yes, I am aware you still pay co-pays and such with Medicare, my mom also had a supplemental insurance plan.
What I am wondering is if the government is going to say Medicare is your insurance , therefore you do not need to purchase the additional insurance. Being that Medicare IS health insurance? So if you are not required to purchase additional insurance, then for the elderly it would remain just as it is and they would not be paying more than they do now.

People on Medicare already have insurance.
If you're on Medicare just ask your Doctors an even the hospital if they will take just the 80% and not bill you the rest. If you do this before treatment many will agree. I told that to my mom and her doc said no problem. Same with my Daughters insurance. I asked her doctors and they both said yes. The insurance pays 80% and the doctors never bill for the rest. It doesn't hurt to try. |

good thought...
many in their 60's 70's are getting Maint. type ops...wrists...knees...etc. the premiums my parents pay aren't really a copay... 25.00 etc... these are add on policies... like 200.00 each.... per month :/ .... ... I'll ask them again
Penham .. that raises a point... I think what they offer is going to be basic...and if you want the high quality offerings (it will be a "Health Menu" of policies) you will have to pay for it.
Only... it will be required ...no option to be an
American who saves by not buying Health Care.

TOP 10 WAYS HEALTH INSURANCE REFORM WORKS FOR YOU 1 ENDS INSURANCE COMPANY DISCRIMINATION —The Affordable Health Care For America Act will stop insurance companies from denying coverage to Americans with pre-existing conditions such as heart disease, cancer or diabetes and from hiking up rates or dropping coverage for those who get sick.2 MAKES COVERAGE MORE AFFORDABLE —The House bill will rein in rising health costs for American families and small businesses—introducing competition that will drive premiums down, capping out-of-pocket spending, ensuring no more copays for preventive care, ensuring no yearly caps on what the insurance company will cover, and providing premium subsidies for those who need them. For small businesses, tax credits will help them cover their workers and eliminating health status rating means they won’t pay higher premiums based on their employees’ health status.3 IMPROVES CHOICE AND COMPETITION —In most states today, one insurance company controls nearly half the market. To increase competition and keep insurance companies honest, the House bill provides those who must buy their own insurance the choice between private plans and a public health insurance plan. The nonpartisan Congressional Budget Office (CBO) estimates that this public health insurance plan would save taxpayers tens of billions of dollars.4 ENSURES QUALITY COVERAGE FOR 96% OF AMERICANS —The CBO estimates that the House bill will result in health care coverage for 96% of Americans. This will lead to significantly reducing the current cost of providing uncompensated care for 46 million Americans, and result in lower costs for everyone and savings to the economy.5 DOES NOT ADD ONE DIME TO THE DEFICIT —According to CBO, the House bill reduces the deficit, while covering 96% of Americans with quality affordable health care.6 IMPROVES OUR FOCUS ON WELLNESS AND PREVENTION —The House bill will work to change the focus of our health care system from treating sickness to promoting wellness with several provisions such as eliminating out‐of‐pocket costs for recommended preventive services, strengthening community-based wellness services, and rewarding primary care.7 IMPROVES QUALITY —The House bill ensures that it is doctors and patients—not insurance companies—making health care decisions. More family doctors and nurses will enter the workforce—helping guarantee access. It moves us toward a system rewarding the quality of care—for instance through accountable care organizations and medical homes.8 STRENGTHENS MEDICARE —The House bill improves Medicare: extending Medicare’s financial solvency by 5 years improving coordination of care and reducing errors for seniors with conditions like high blood pressure and diabetes eliminating the prescription drug (donut hole) coverage gap over a period of years; and providing free preventive care and wellness check-ups.9 CUTS DOWN ON FRAUD, WASTE AND ABUSE —The House bill will strengthen oversight and enforcement measures to cut down on fraud, waste and abuse in the health care system, which is estimated to cost more than $60 billion every year.10 LOWERS COSTS OVER THE LONG TERM —The House bill rewards care that prevents hospital readmissions, promotes doctors working together to coordinate your care better, cuts waste and fraud, invests in prevention and wellness, strengthens primary care, and reforms reimbursement to provide incentives for the quality, not the volume, of services. |

Here is a little tidbit on Medicare Advantage which is a tax subsidy program for insurance corporations. This was originally supposed to be the end all be all of Medicare, and was pitched upon its creation many years ago as the private sector answer for Medicare and they were going to show us all how much cheaper and better they could do the same thing (Medicare Fee for Service).
Well didnt happen now we (Tax payers) pay on average 15% more for these4 corporate handouts to provide the same thing that Medicare provides.
Time to end this sharade and save the tax payers billions.

OVERPAYING MEDICARE ADVANTAGE IS AN INEFFICIENT WAY TO PROVIDE EXTRA BENEFITS Some have touted MA as a way to provide more benefits to people living in rural areas or those who have lower incomes. This is an inefficient way to provide increased benefits. First, those benefits only go to those people who find an MA plan that is acceptable to them. Second, taxpayers spend on average 14 percent more for MA beneficiaries. In some MA plans, the government spends $3 for every $1 of extra benefits offered, giving private insurance companies three times as much as they give to beneficiaries. Third, MA plans may provide extra benefits, but they also often charge more for certain services or items than the traditional Medicare fee-for-service program. The more efficient way to provide new benefits for Medicare beneficiaries – and the only way to assure access for all Medicare beneficiaries who need the new benefits – is to add them to the traditional Medicare program. That’s what this bill does. It is important to note that when benefits are added to Medicare, they automatically become part of the basic benefits in MA, but are no longer decided solely at the discretion of the private plan or only provided to people who happen to enroll in private plans. The bill follows a more equitable and efficient approach. Under these reforms, all seniors and people with disabilities will obtain preventive services with no copayments, Medicare prescription drugs without a donut hole, better access to mental health providers, and improved financial help for those with low incomes. |

I am sorry but to change the whole system for 15% of the people is stupid. We need to let Insurance companies sell across state lines, give tax credits for people who have a hard time paying for health insurance and finally require health insurance companies distribute or take a certain percentage of people with pre-existing conditions.
This is NOT BRAIN Surgery! Start simple and go from there but these jerks in D.C. want to slip a lot of junk in to support abortion, and give illegal aliens health care coverage and then make poor families face jail if they have no coverage. Go figure! |

It is not to late to write your senator and inform that that if this bill becomes law you will never vote for them or any democrat again.
They dont want to give up their lucrative job ever. But if they receive enough emails from people saying it is time to just say no, they might listen. I have written mine today. |

Why call? Can't I just send an email? Emails are great, but a call is worth a thousand emails! Calls are more personal and more noticeable than emails because staffers have to deal with them in real time. Senate offices keep close tabs on constituent calls and those tallies can influence votes.

James Fallows isn’t being subtle about pointing the finger at Betsy McCaughey: A huge photo on his blog leaves no room for error about who’s to blame for the “Death Panel” rumors. Neither is the New York Times, singling out McCaughey on the front page for derailing the health care debate with pernicious rumours. Again. Who is Betsy McCaughey? Fallows explains:
The New York Times today traces how McCaughey’s claim has been picked up by the conservative media:
Fallows says he can’t believe that this time around, the modern media, with its millions of Internet fact-checkers now built into the process, wasn’t immune to this kind of rumormongering. Well, it’s not because they weren’t warned: On July 29th, Greg Sargent’s Plumline carried this headline: Figure Who Helped Kill Health Care With Distortions Last Time Rides Again (I just saw this via Andrew Sullivan, whom I checked as soon as I made the McCaughey-New Republic connection. Alas, he has not weighed in on this just yet. Hmm.) On July 31, Salon’s Joe Conason wrote “Will Bill and Betsy Kill Again?“, incredulous: “Knowing what we have since learned about him and her, it is hard to believe that anyone believes anything they say. But once again it is their words — brimming with falsehood, stupidity and possibly both — that inspire the opposition and confuse the public.” It’s not that the fact-checking isn’t there – Conason traces the McCaughey ‘end-of-life counseling’ rumor back to mid-July on Fred Thompson’s radio show, saying the healthcare reform bill would make it mandatory — absolutely require — that every five years people in Medicare have a required counseling session that will tell them how to end their life sooner.” Conason points out that Politifact.com debunked this as a ridiculous falsehood. But debunking takes time and effort, especially when rumours spread. Wednesday, Time’s Michael Scherer pointed to how McCaugheys fallacious New York Post column attacking Ezekiel Emanuel, brother of Rahm, as a deadly doctor had spread like wildfire, catching him off-guard. Guess who wrote the column? Look no further than the smiling blonde above. Paul Krugman’s column today, Republican Death Trip, doesn’t even mention McCaughey — its about Chuck Grassley’s role, which he calls “flat-out despicable.” But the hand of McCaughey is behind Grassley, too (no matter how much he may claim that hes no nail):
It also may be worse because this message machine has so many more amplifiers: Blogs and Twitter and YouTube and Drudge and HuffPo and 24-hour cable news shows who shout first and fact-check later. It’s a multi-media many-headed Hydra, and as anyone who knows a little mythology (or has read Agatha Christie!) knows, its bloody impossible to contain because as soon as you cut off one head, up spring two more. That’s how it is with debunking these rumors: They are carelessly thrown out, exaggerated and amplified, and why not? Its the other side that wil have to go through the laborious process of fact-checking and proving why they’re wrong, using up precious time and labor to do so. Do you think all the people who watched Glenn Beck’s crazy eugenics segment instantly rushed to their computers to fact-check him? Er, not quite. Probably more than a few of them rushed to make hand-held signs that they could then wave angrily at a town hall. For the TV cameras. So: Now what? The New Y ork Times is (now) on the case – will that make the Washington Times recant? Stop publishing McCaughey? We all know the answer: It won’t. Which is too bad, because anyone who knows a little mythology knows, too, that that’s the only way to stop it. The next best thing may just be to keep vigilant eye out at all time, and never to assume fact-checking is the end of it. The good news is that the bill that cleared the Senate Finance Committee last month
would do a good deal more to contain rising medical costs than the bill the House
adopted.
The House's health care reform bill passed on party lines despite the defection of 40 Democratic representatives. Putting together a winning coalition is bound to prove more difficult in the Senate, where a single Democratic senator's objection could doom any reform bill to failure. Article in full

Nelson is not the only Democrat who has threatened to vote against cloture. Sen. Joe Lieberman (I-Conn.) has said he would filibuster a bill with a government-run health insurance plan, or public option. Sen. Evan Bayh (D-Ind.) said on CBSNews.com's Washington Unplugged that he would even block a motion to proceed with debate on the bill if he strongly objected to the legislation.

As a veteran, so far I am not involved with Medicare or other health insurances. And even more so am less informed on the specifics of this bill. Probably I could use a very simple statement as to when the dust clears- will Medicare remain? Also, recently, as per my medical problems, it was suggested I apply. It turns out I am not qualified to receive it. The devil is often in the details- these being at the end of this healthcare program is what I understand a default- in the end, despite all rules, all policies, all numbers, committees, or groups will finally decide who gets what and who doesn't. Something like an absolute veto authority. This makes pages and pages and nice sounding to everyone rhetoric boil down to -in the end- those given power in system will say -yes - this covered- or no this is not. Am I oversimplifying? I don't understand your healthcare system too well, but it sounds so confusing to me, and more than a bit unfair.
Here in Ireland, like Britain, we have socialised healthcare. It's not free, but everyone has a right to the treatment they need. There are problems, the government mismanages it a lot, and it's underfunded, but the basic principles are sound. I hope you in the States work around the issues, and see the advantage in universal healthcare that includes everyone, regardless of income. All the best people. |

If you are a family say : a Dad, a Mom, a daughter and a son.
You dont buy the health insurance. Who goes to jail, the Dad? If he goes to jail, now the burdan of buying the health insurance is on the Mom, if she doesnt then go to jail, and is put in jail, then the daughter has to buy the insurance and she doesnt, so she goes to jail. Next the son and he doesnt buy the insurance, he goes to jail also. Does this make sense? |
